0. Preamble

Cyberté Création SARL, Siren 478 579 329 - RCS Romans, 169 impasse de Malgras, 26170 Buis les Baronnies, is the provider of this website.
Internet customers and Cyberté Création are only contractually bound to the extent that Cyberté Création makes available to customers, within the framework of these General Terms and Conditions, an interface enabling sales to be made with the seller. Cyberté Création is not a representative, agent or mediator of the Customer, nor is it an employee or employer of the Seller.

1. Acceptance of conditions

When the Customer clicks on the "validate your order" button, he declares that he accepts the order and these general terms and conditions of sale in full and without reservation.

2. Products

The photographs illustrating the products are not contractually binding. In the event of errors, the seller cannot be held responsible. All products presented on the site are offered within the limits of available stocks of the seller and its suppliers.

The seller cannot be held responsible for any stock shortages.

3. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. The customer will receive confirmation of his/her order by e-mail. The seller reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order. The information provided by the purchaser when placing an order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

4. Reservation of ownership

Products ordered remain the property of the seller until full and final payment has been received (Law of May 12, 1980).

5. Prices

All product offers are priced in euros and are not subject to VAT (art. 293 B of the French General Tax Code). The price indicated in the order confirmation is the final price, including postage and packing, depending on the recipient.

All orders, whatever their origin, are payable in euros.

The seller reserves the right to modify its prices without notice and at any time, but undertakes to apply the current prices indicated to the customer at the time of ordering, subject to availability on that date.

6. Availability

The seller accepts orders subject to availability. The customer is informed of product availability on the product information sheet. If, despite the seller's vigilance, an ordered product is unavailable, the customer will be informed by e-mail as soon as possible and a suitable solution will be proposed: either a new availability period for the product, or an exchange of the unavailable product for another product, or reimbursement of the said product. In this case, Cyberté Création will reimburse the customer by credit card or by cheque made out to the name and address of the customer who placed the order.

7. Payment

The price invoiced to the Customer is the price indicated on the order confirmation sent by the Vendor.

The price of the products is payable in cash on the day the order is placed. Payment may be made by credit card bearing the CB symbol, by bank or postal cheque issued by a bank domiciled in France, by bank transfer, or by money order, any bank charges being borne by the Customer. Cheques should be made payable to Cyberté Création and sent to: Cyberté Création SARL, 169 Impasse de Malgras - 26170 Buis les Baronnies.

Orders are reserved for 10 days. After this period, without receipt of payment, the order will be cancelled.
The order will not be processed until payment has been received and validated.

Cyberté Création subscribes to secure online payment as a registered distance-selling merchant.

Payment is made directly to the bank's server in a secure environment, without passing through the store's server.

Should the bank payment centers concerned refuse payment, the order will be automatically cancelled and the customer informed by e-mail.

8. Delivery

Orders are delivered by the seller to the destinations indicated in the postage and packing schedule and at the rate indicated according to the weight of the total order.

For other destinations, please contact us for a quotation.

After order confirmation, deliveries are made by La Poste. For Metropolitan France, the shipment is made by colissimo or, more rarely, by letter. Shipments are deposited in letterboxes. Only colissimo orders with a total value (excluding VAT) of over €90 are eligible for delivery against signature. The average delivery time for a colissimo is 48 hours on working days.

For deliveries outside mainland France, the Customer undertakes to pay all taxes due on the import of products, customs duties, value added tax and any other taxes due under the laws of the country in which the order is received.

The seller and Cyberté Création shall not be held legally liable if the Customer fails to pay such taxes. Any delays do not entitle the purchaser to claim damages.

Delivery times are given for information only and are in no way guaranteed by the seller.

For Colissimo shipments, the customer can track his parcel on the www.coliposte.fr website by entering the parcel number communicated by e-mail.

For shipments sent by Colissimo with signature, in the event of the recipient's absence, a notice of pending delivery is left by the post office in the mailbox. The waiting period at the post office is 15 consecutive days.

If the delivery by the Post Office or the carrier cannot be made and the parcel returned, the seller reserves the right to refund the price, all shipping costs remaining at the customer's expense.

Always check your parcel on arrival. In the event of damage or missing items, the customer must express reservations in writing on the delivery note and confirm these reservations to the seller by registered mail or e-mail within 48 hours.

In the event of apparent defects, the purchaser benefits from the right of return under the conditions set out in this document.

9. Claims and returns

All product returns must be approved by the seller.

Products ordered on the site may be returned in the event of non-conformity with the order placed by our services or in the event of a defect. These products must be returned in their original packaging, accompanied by the order form and mentioning the defect noted.

Products will not be replaced if used, opened, damaged, incomplete or damaged.

In the event of damage or shortages, the customer must note any reservations on the carrier's delivery note and notify the seller within 48 hours by registered letter. In the absence of justified reservations, the seller may refuse to replace or refund the product.

The product must be returned within 7 days of receipt, as evidenced by the post office receipt.

Upon receipt of the product in due form and after examination of the product, the seller will proceed, according to your choice, with either the exchange or refund of the product concerned.

All refunds will be made by bank cheque by Cyberté Création in the name and address of the customer who placed the order.

10. Withdrawal

You have 14 days (from receipt of the products) to make up your mind. In the event of an exchange or refund, return the new product(s) in their original packaging, undamaged, together with any accessories, instructions and documentation, to the seller at the following address

If the right of withdrawal is exercised, the seller is obliged to reimburse the sums paid by the customer, free of charge, with the exception of return and shipping costs. Reimbursement is due within a maximum of 15 days.

11. Disputes

The present contract is subject to French law. The seller cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products sold. The same applies to any product modifications resulting from manufacturers. In any event, the seller's liability shall be limited to the amount of the order, and shall not be held liable for simple errors or omissions which may have occurred despite all the precautions taken in the presentation of the products.s in the application of the present contract, the purchaser has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of a professional association of the branch, an association of consumers or any other council of his choice.

Please note that the search for an amicable solution does not interrupt the "short period" of the legal warranty, nor the duration of the contractual warranty. As a general rule, and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual warranty assumes that the purchaser honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company for an amicable solution.

Failing this, the Commercial Court of Valence shall have sole jurisdiction, irrespective of the place of delivery and method of payment accepted.

12. Warranty

In all cases, the vendor may not be held liable for failure to comply with the regulatory and legislative provisions in force in the country of receipt. of the seller is systematically limited to the value of the product in question, value at its date of sale and this without any possibility of recourse against the brand or company producing the product.

In all cases, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 et seq. of the French Civil Code). Provided the buyer can prove the hidden defect, the seller is legally bound to repair all the consequences (art.1641 et seq. of the French Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the French Civil Code).
